Evilbong's Terms of Service
!!By Commissioning me, Eiko/Evilbong, in any type of way, you are agreeing to the Terms of Service below!!

I. GENERAL TERMS.

Please provide a clear and easy to understand description of your commission if there is something specific you would want for your commission.
If you can, please provide any visual references to aid with the commission.
If you only have written references, please take a moment to find a few photos that portray your idea - I do not take purely written description for references, as the margin for interpretation is much too wide.
Any ill behavior or comments will not be tolerated and your commission will be canceled and refunded if it occurs.
Please keep in mind that I am not one for small talk. It is hard to focus on work and life whilst texting another person. You are always free to check in on the commission process but do not do it every day.

II. PAYMENT AND QUEUE.

All commission types are paid through Paypal or Kofi and are paid in full. Once paid, then your name will be added to my queue list.
The spot at which you land in the queue list depends on when the payment was made. I work on a first come first serve basis, so if someone paid for a commission before you, you must wait for their commission to be complete before I begin working on yours.

Payments will have two full days (roughly 48 hours) to make payment from the time a commission agreement is made - holds are also due within that time frame. If no payment is received in that time, the client will lose their rights to the commission slot, unless the client has otherwise discussed other terms. Dropping out on either a hold or a sale does make me less inclined to work with an individual, I hope that’s understandable!

III. PROCESS.

Work In Progress (WIP) pictures will be given to the commissioner once I get to their commission.
I will provide WIP pictures throughout the drawing process that are to be approved by you.
Once completed I will share the final product to you which, upon request, I can send through via email or other means.
I do not and will never share the files (PSDs) to which the art piece originated from to prevent stealing and modification of my art.

IV. EDITING.

Throughout the process, edits may need to be made for the customer's satisfaction. The customer may request edits to the sketch wip to ensure no edits need to be made throughout the later process.
If edits are needed to be made past the line-art WIP, then only a few may be given. If the amount of edits become too much, then I will ask for an extra payment to cover for the extra work.
You are allowed to deny paying the editing fee however, your commission will not be able to receive any more edits.

V. COPYRIGHT / USAGE POLICY.

I, the artist, hold every right to the produced drawing, not the commissioner.
Therefore I´m allowed to use the copyrighted artwork to;
Promote myself in any place or site.
To display it anywhere to my liking.
Post it wherever I want.

The commissioner is allowed to;
Use the copyrighted artwork for personal use only unless agreed otherwise.
Print the art, and claim the right of their character(s) but not the drawing itself.
Use the art to promote themselves with proper credit given to the artist.

You are NOT allowed to use the artwork for profit of any kind unless the commission was bought for commercial use.
A Purchase of Commercial rights to the artwork will always be 500% of original price.
With commercial rights you are allowed to make any sort of merchandise with the artwork. This includes making and selling clothing with the artwork, use the art for books or posters, and promoting your own brand with it. Credit is still required for usage of the artwork.
If you break the copyright infringement in any way, every right you had to the drawing will be retracted and you will become blacklisted.

VI. CANCELING AND REFUND POLICY.

I do not offer any refunds for adoptables or completed commissions.
Full refunds will be provided if work has not started, regardless of the time frame.
On this note though - please do not use me as a ‘digital wallet’ and ask willy nilly for refunds. Repeated refund requests very close to the original commission date will eventually lead to blacklisting.

For illustration commissions: Clients may ask for a refund at any time, even if work has already started - returned amounts are based on work completed relative to what the full completed work had been.
For example, a flat-color fullbody consists of 3 major steps - sketch, lines, and color. If a client requires a refund when the sketch is complete (i.e. 30% of the work is done), 70% of the total funds would be refunded.
Similarly, if I had already started on the lines, I would gauge what % of that 30% I have completed, and charge accordingly. If I were half-way done with lines, I would charge 30% for the sketch + 15% for the lines, totalling 45% of the work done for a refund of 55%.
Art completed up to that point will be delivered for illustration commissions.

If you file a chargeback against me, your right to everything I have ever made for you will be retracted and I have the right to sell the copyrighted artwork to new buyers.

I retain full rights to my work; this includes, but is not limited to, reposting, printing, or redistributing. This includes intellectual rights!
